judge jeanine pirro, richard fowler, dana perino, and greg gutfeld. it's 5:00 in new york city, and this is "the five." ♪ ♪ it is the fifth day of the presidential witness protection program. joe biden is as elusive as bigfoot, holed up in the mountains of camp david, 16 debate propers making him cram like crazy for the cnn presidential debate that is just two days away. they are worried joe is going to blow it so they aren't taking any chances. they actually bu build him a set that would make steven spielberg blush p or go outfitted with lights and production equipment. joe biden's camp counselors are also said to be whizzing back and forth on golf carts as they dipped in and out for strategy sessions. but is it too much? the media is concerned that aids are injecting joe biden with too many facts.

or their sexual orientation, i don't care about any of that. what i do think is 16 people sounds like a lot. president bush would have said, i need four of you. the rest of you can leave. because it is too much. also you are the president. you have been doing the job. presumably you should know your own record, and running against the guy you ran against before so you should know his record, and you talk about him all the time, in a way that is very partisan. what is interesting is what karine jean-pierre just said, going to talk to a broader base of americans fear i'm looking forward to that for both of them. it's a debate that's a chance for them, americans, leaning or maybe unenthusiastic about voting for either of us come here is my vision, and i also want to see how they react under pressure. a lot of this previewing is just because the press doesn't have a lot to talk about. i admire any communication

print a body double? i don't know. then they are doing it in an airport hangar? are they detonating a bomb? are they handling a contagious virus? could they do this in an empty auditorium right around the corner? they are investing more time and effort on this than anything that mattered to the american people for four years. not immigration. not crime. not inflation. they are acting as though joe is ukraine and trump is putin. like, the entire weight of their administration is being directed toward 90 minutes with darth vader. if they only had the same energy for their real job, could you imagine if they looked at illegal immigration the way they looked at trump? if they looked at crime the way they looked at trump? if they looked at inflation the way they looked at trump? they wouldn't have to look at trump then. they would be okay. but they are in a panic. >> jesse: that is why this 90 minutes, judge jeanine, is the most important 90 minutes for the entire progressive

movement. if he doesn't do well, trump is reelected and this whole progressive experiment that they are running on the country is over. is dead in its tracks. >> judge jeanine: you know, i understand that this is the earliest presidential debate in history, in recent history, anyway, they usually don't debate this early. i think the biden people have agreed to this knowing that there will be early voting. they believe that joe is going to do well, and i think i have said myself, i think he is going to over perform, but having done a debate myself from a statewide debate, when i ran for attorney general in new york, one of the things i learned is if they keep prepping you and prepping you and prepping you, you are going to make a mistake, okay? because you are going to be so worried that you got something wrong, when you know in your gut, you've got the job, joe biden should know the job, donald trump certainly knows the job, and here's the difference. joe biden, they will have given him several lines that he's got to memorize. and understand that they are

preparing him for the off-the-wall donald trump and for the more restrained donald trump that we have been seeing, and so he has got to try to figure out which one it is. but in addition to that, donald trump has to deal with -- and i said this the other day -- not just dana bash and jake tapper, he's got to deal with the fact that he's got cnn and he's got moderators who don't like him, and i'm kind of thrown back to, i think it was in 2012, when obama was debating mitt romney, and mitt romney was complaining that in benghazi, the president had not declared that it was a terrorist event for 14 days. it took them 14 days. and candid probably, the cnn moderator, comes in and says, that's not true, and candy was wrong, but it didn't matter. i have concerns about being biased, these moderators, let's not kid each other, they are, what role will they play? and then there is another person

in this debate against donald trump, and that is juan merchan. juan merchan is a cut down the gag order and now trump has to decide what he can and can't talk about waste on the latest juan merchan ruling on a gag order that should have been thrown out soon as the jury made a decision. so i think knowing that cnn doesn't even take donald trump's speeches. they wouldn't allow carolyn levitt, his spokesperson, to even finish a statement. you know that cnn is doing everything it can't hurt trump. >> jesse: richard, are cnn moderators thing to be fair and balanced? >> richard: just as fair and balanced as you. >> jesse: i'm not a moderator. >> richard: exactly. zooming out on this particular debate, i agree with dana, we talked about debate prep, i want the debate to be over. i do think for both donald trump

and president joe biden, the next -- this thursday 90 minutes will be very consequential for both of their campaigns, right? is going to determine who wins and loses the election. because it is so early, to the judge's point, especially the double deniers, the double debaters that pollsters are talking about and both candidates will be looking to expand their base and try to find these independent voters, which of these candidates serve me best? which candidates speak to me best? i think it's going to be very interesting to see how both of these men play because the consequence is are going to be dire or good in either case. i think it is also worth pointing out because i did the same jaunt down memory lane to see how other presidential candidates prepare for debates, and there is not much stories about being away for a very long time, but it is worth pointing out, now senator of mitt romney, then governor romney, he did also spend some time debating stage prep, how should i present -- what body language should i use? how should i respond to the moderator? there is a whole story and "politico" from 2020 about that.

only person in america that hasn't debated both donald trump and joe biden. she also has a litany of experience that speaks to many of the issues that will come up in this debate. i think the idea she wrote an op-ed makes sense. she has a book coming out, so it makes then she wrote an op-ed, where you are the most relevant in this moment. it is also worth pointing out when you talk about the 16 folks helping biden prepare, a lot of those folks are folks from the former obama white house. talking the last segment, she played candy crowley in his debate prep in 2012. these staffers have continued to stay because i think it is more than just barack obama or hillary clinton, there is this idea that, look, this is about making sure this candidate makes it over the edge and also weep pass for the american people. it is adjusting to the how this plays out, especially given the fact they are going to have to do this debate in 90 minutes, not about talking to democrats or progressives, were in the case of trump, talking to folks who are moderate supporters,

the amazing part of this is i believe it was a couple weeks ago that the justice department issued a press release that the final defendant was sentenced in a freedom of access -- one of the crimes which is related, of course, to this kind of crime, as well, and a woman apparently obstructed the path to an abortion clinic. she didn't commit any kind of violence. she didn't threat anybody. she literally blocked, with her body, the path, and they went around her. do you know how much time that woman was sentenced to? 24 months. and the department of justice is proud of the fact that under this act, they were able to incarcerate a woman for 24 months, but they are not able to incarcerate anyone there? that is a violent act. the l.a.p.d. confirmed that one person was arrested. >> dana: it's outrageous.
