Residence permit: how to apply?

To request a residence permit, a foreign citizen must contact the Police Headquarters of the province in which the citizen wishes to reside, according to lawArticle 5, paragraph 2 of bill 286/98 and subsequent amendments to Consolidated Law on Immigration.

The request for a residence permit must be made within 8 working days following entry, otherwise the request will be rejected and the foreign citizen expelled, unless the delay is due to him or to force majeure.

The request will be presented to the Police Headquarters of the province where the citizen wishes to stay via the "Sportello Amico" of the authorized post offices.

As regards the Residence Permit requested for subordinate work, a completed form must be submitted to the One-Stop Immigration Desk of the UTG Prefecture. Also in this case the deadline of 8 days from entry applies.

The residence permit requested for self-employed or subordinate work can ONLY be used for the provision of the reported service, a work activity for which the authorization has been granted.

Intracompany detachment: what does it mean?

Let's clarify the meaning of intra-company detachment.

Intra-company secondment is defined as "temporary secondment of a foreign worker by a company established in a third country to the host entity".

The employment relationship between the worker to be transferred and the posting company located outside the European Union must be regulated by the subordination contract that has been active for at least three months without interruption immediately before the date of transfer.

The posted worker must be hosted either by a hosting entity established in Italy belonging to the company or the same group of companies.

Intra-company secondment: what are the obligations of the seconding company?

The foreign company that requests the secondment of its employees or independent personnel has the obligation to give prior notification of the secondment to the Ministry of Labor and Social Policies within one day before the transfer, providing the following information:

– Data of the foreign company requesting the posting

– Number of self-employed or employed workers who must be posted

– Total time span of the postings, start and end dates.

– Address of the place where the self-employed or employed workers will work.

– Data of the subjects to be seconded.

-Type of services provided by workers.

– Data of the contact person designated by the foreign company domiciled in Italy and responsible for sending and receiving the deeds and documents.

– Data of the contact person designated by the foreign company, who as representative maintains relations with the social partners involved.

– Number of the authorization provision to carry out the activity.

Blue Card: what is it?

The EU Blue Card, Blue Card, is a specific type of residence permit that was introduced by legislative decree of 28 June 2012 n.100 and which is issued by the police headquarters to highly qualified workers coming from countries that do not belong to the European Union.

The work of the non-European citizen must be regulated by a work residence contract which must have been communicated to the police station.

The duration of validity of the Blue Card differs depending on the individual employment relationship.

If the employment relationship is for a fixed term, the blue card has a duration of two years, if the employment relationship is for a fixed term, the residence permit lasts three months longer than the expiry of the employment relationship.

To obtain the blue card, the non-European citizen must perform work as a self-employed worker for another natural or legal person who otherwise has an employment relationship as an employee. The application for authorization must be presented by the employer to the prefecture.

The highly qualified work must be certified by suitable qualifications and professional qualification certificates that have been issued by the non-EU citizen's country of origin.

The blue card can be issued to: foreigners resident in a non-European Union state; working citizens who reside in Italy regularly; citizens who regularly reside in another EU state; citizens who are in possession of a Blue Card issued by another member state of the European Union.

Highly skilled workers: who are they?

Highly qualified managers and employed or self-employed workers are workers who have obtained recognition of the high professional qualification and specific to the reference sector through the certification of their work, which must be specialized in the sector continuously for at least six months.

Managers or highly qualified staff of companies that have Italian branches, representative offices of foreign companies.

The temporary secondment must not exceed five years. Its duration is defined based on company needs and may be subject to extensions.

According to the Decree of the President of the Republic of 31 August 1999 on the Consolidated Law on Immigration, at the end of the transfer it is possible to hire fixed-term or permanent staff in Italy.

Entry for the self-employed: what is needed?

To issue the visa and transfer it is necessary:

– the employment contract stipulated with the company endorsed by the Territorial Labor Directorate.

– Authorization obtained at the police station attached to the request for the transfer.

All documentation demonstrating professional skills and carrying out work in the company sector for at least six months.

Entrance for employed workers: what is needed?

To issue the visa and transfer it is necessary:

Request for work authorization which must be sent to the One-Stop Shop for Immigration in the prefecture by the company after completing a specific form.
